State health officials are proposing a green-yellow-red rating system for assisted living facilities, based on their inspection scores. "[T]he proposed process would require less paperwork, clearing more time for surveyors to do more inspections." The color codes would be posted in the facility and on a state website. |

"Two bills headed to the Alabama House and Senate health committees are aimed at increasing the penalties for operators of unlicensed assisted-living facilities…." The bills are, in part, responses to a recent Shelby County case in which two sisters in their 30s with cerebral palsy, mental retardation, and epilepsy were removed from an unlicensed assisted-care boarding home when it was discovered that one of them had been sexually abused. |

Editorial supports Senate bill 338, which would raise the fine for operating an unlicensed facility to $25,000 (from the current $5,000) and would impose a $3,000 fine on any health care provider who knowingly refers an individual to an unlicensed facility. Also supports SB 337, which requires officials to investigate and "determine the nature of the residents" if more than three unrelated adults are receiving public assistance checks at a single address, to determine if there is actually an unlicensed facility there. |

The report, which examined prisoners released in 15 states in 1994, found that 68 percent of the non-sex offenders were arrested for a new offense within three years, compared with 43 percent of the sex offenders." |
