House Bill 105 has passed the House. It outlines the "precise steps to be taken from the time a complaint is filed with the Cabinet for Families and Children until it is resolved….[Also,] Kentucky State Police and local law enforcement agencies would have to give the cabinet an annual report detailing each case and its disposition. The cabinet, in turn, would have to send a summary to the General Assembly." |

By a unanimous vote, the Kentucky House passed House Bill 159, which would make it a felony carrying a prison sentence of 1 to 5 years and a fine of $5,000 to $10,000 to intentionally inform a long-term care facility of an impending inspection. |

House Bill 672 would permit the state to levy fines of $1,000 to $5,000 against operators of unregistered boarding homes, jail people that solicit boarders for unregistered homes, shut down registered homes that pose health and safety risks to residents, and prohibit people who have been convicted of abuse from operating boarding homes. It would also require the state to set up screening procedures to ensure that residents are capable of caring for themselves. |

One new law will "require a criminal background check on anyone being hired to work in a state psychiatric, mental health and mental retardation long-term care facility. No person found to have been convicted of felony elder abuse, drug abuse, theft or violent crimes will be permitted to be hired." Another new law that may affect vulnerable elders and disabled adults gives limited immunity from civil liability to employers who provide "accurate job performance information on their past or current employees to another employer." |

The lead sponsor of an elder abuse bill, Rep. Jimmie Lee, says the bill would guarantee a "full paper trail" on every adult abuse case, including the outcome. "We don't have any way of knowing whatever happened to it [now]," said Lee, D-Elizabethtown. "We don't know whether or not a prosecutor somewhere said there's not sufficient evidence for us to do anything, and they canned it. Under this bill, you have to report every one of those incidents." |
