Title: Domestic violence survivor hopes new state bill will help protect others

Comments: New legislation is expected to be introduced this week that "toughens penalties for acts of domestic violence and requires offenders to complete a treatment program. The reforms require specialized training for law enforcement personnel to deal with domestic violence cases. It also creates a new state fund to provide legal services to domestic violence victims. The state also would develop a plan to provide victims with mental health and substance abuse services if needed."

Title: Bill disappoints adult-care advocates

Comments: Advocates thought they were pushing a bill that would require criminal background checks of any worker in any nursing home or adult rest home, funded with $178,000 for four staff to conduct the checks. They have learned the Senate version will only require checks of employees of rest homes, and only those with direct responsibility for caring for patients.

"A 1999 law calls for the state to deny a license to homes that are part of chains with persistent problems. State officials say the law does not apply to Careamerica's homes because the homes are licensed under different names." Also includes room-by-room inventory of problems at one facility.

Title: New N.C. laws toughen domestic violence, meth penalties

Comments: Among 20 new laws that go into effect December 1 are ones that create a new felony crime of assault by strangulation (which can now bring up to 2 years in prison), lower the threshold at which an assailant qualifies as a habitual misdemeanor assault offender (which then ups the crime to a felony), and eliminates a loophole that allowed convicted felons from possessing guns. The domestic violence measure also requires offenders to be placed on probation to enter an abuser treatment program. Sexual assault and stalking victims will also now be able to get "stay away" orders even if they have not had a previous personal relationship with the offender.

Comments: "Effective Saturday, a new state law requires a comprehensive criminal background check on all job applicants at nursing homes, home health care agencies and mental health facilities. But federal privacy guidelines undermine the new state law. The FBI won't release results of national background checks on unlicensed employees such as janitors, secretaries and dieticians who have direct contact with residents [of] private nursing homes…. The federal government also won't funnel the information through a state agency such as the Department of Health and Human Services as originally planned, when state lawmakers passed legislation earlier this year."
