Title: N.D. nursing homes have highest percentage of fire-safety violations

Comments: "About 98 percent of North Dakota's nursing homes had fire-safety violations in the last year, the highest in the nation, according to a report released this week by the U.S. Government Accountability Office….The high incident rate reflects the state's diligence in surveying buildings to ensure they are complying with regulations," said one of the authors of the report.

Comments: Gov. John Hoeven, other state officials and the Long Term Care Association's president have reached a preliminary consensus that a special unit in a private nursing home be established for aging and disabled sex offenders. In order to make this possible, "the Legislature may have to change some laws and work with federal agencies on Medicaid reimbursements and other red tape" before the plan would be "feasible."

Comments: The body of a 69-year-old woman has been found. She and her 73-year-old husband with Alzheimer's had disappeared, along with a gun, from their home in mid-August. It is not clear what caused the woman's death.

Title: Supreme Court affirms handling of Van Sickle guardianship case
Comments: "Former federal judge Bruce Van Sickle, who suffers from dementia, was treated properly when a guardian was given charge of his affairs and he was moved to a locked Alzheimer's ward, the North Dakota Supreme Court ruled. The court, in a ruling Monday, did not agree with arguments that the 88-year-old retired judge should have been cared for in a less-restrictive setting, and that his guardian, a Bismarck nonprofit organization, should be replaced with one of Van Sickle's sons."

Comments: Maple Manor Care Center refused to accept as a resident an 81-year-old child molester. Three workers had children who had been his victims, and one resident had a grandchild he had victimized. "Instead, the Cavalier County state's attorney successfully petititoned to have Hall civilly committed to the State Hospital for indefinite sex offender treatment, where he remains."

Comments: Officials have announced that they believe a murder-suicide killed an elderly couple who were found in an abandoned house last fall, three months after they had disappeared. They believe the 73-year-old man killed his 69-year-old wife before himself. The family still believes both may have been killed by a third party.

Comments: Richard Wilkes, 60, a former Burke County state's attorney, has been sentenced to three years and five months in jail, three years' supervised probation, and restitution. In his capacity as a private lawyer, he stole more than $600,000 from the estate of two sisters and spent the money on "exotic dancers."
