Comments: On December 30, the Pennsylvania Supreme Court struck down a 1998 law that "barred nursing homes, personal care homes, mental retardation residences, home health agencies and other providers from hiring anyone with a criminal record that included almost any felony or with multiple misdemeanors of certain kinds…."

Title: State permits ex-cons to work; Guidelines redrawn for long-term care

Comments: In response to a Dec. 30 state Supreme Court ruling, the Pennsylvania Department on Aging has posted new guidelines allowing the hiring of those with criminal convictions by nursing homes and other facilities if the person can demonstrate they've been working with a care-dependent population for at least 5 years since their conviction with no problems.

Comments: The House has passed a bill, HB 2319, that would impose a lifetime ban on nursing home and personal care employment for those convicted of any one of 16 violent or disabled adult abuse crimes. There would be a 10-year ban (with a special employment exemption at five years) for those convicted of any of 33 other crimes such as drug dealing and theft.
